These Terms & Conditions (“Terms”) govern your use of our website (www.wearefoundry.ai) and services, including our community membership, events, educational content and resources.

By accessing our website or using our services, you agree to be bound by these Terms. If you do not agree, please do not use our services.

“Content” means all text, images, audio, video, guides, toolkits and other materials provided by us

“User Content” means content posted by members in our Community

“Member” or “you” means any person using our Website or Services

4. Eligibility

You must be at least 18 years old to use our Services. By using our Services, you confirm that you meet this requirement.

Our Services are intended for business owners, leaders and professionals. They are not designed for children or personal, non-business use.

5. Account Registration & Security

5.1 Free Community Access

Basic access to our Community is free and requires registration with your name, email address and location.

5.2 Paid Membership

Paid membership tiers are processed through our Community platform (Heartbeat) using Stripe. Separate account registration is required.

5.3 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorised use

We are not liable for any loss or damage arising from your failure to protect your account information.

6. Membership Tiers & Access

6.1 Free Tier

Free membership includes:

• Basic Community access
• Newsletter subscription
• Access to selected free resources

6.2 Paid Tiers

Paid membership tiers (Entry Tier, Full Access, Team Package) include additional benefits as described on our website and Community platform.

Access levels and benefits may vary by tier and are subject to change with notice (see Section 15).

6.3 No Free Trial

We do not offer free trial periods for paid membership tiers. Free tier access is available to all eligible users.

7. Fees & Payment

7.1 Pricing

Current pricing for membership tiers is displayed on our website and Community platform. All prices are in GBP (£) and include VAT where applicable.

7.2 Payment Processing

Payments for paid memberships are processed by Stripe through Heartbeat. You agree to provide accurate and complete payment information.

7.3 Billing Cycle

Paid memberships are billed monthly or annually as selected during registration. Billing occurs automatically on the renewal date unless cancelled.

7.4 Price Changes

We may change our pricing with 30 days’ notice. Changes will not affect your current billing cycle but will apply upon renewal.

7.5 Failed Payments

If payment fails, we may suspend or terminate your access until payment is received. You remain responsible for outstanding fees.

8. Cancellation & Refunds

8.1 Cancellation by You

You may cancel your paid membership at any time through your account settings on Heartbeat. Cancellation takes effect at the end of your current billing period.

8.2 No Refunds

Membership fees are non-refundable. Once you have access to paid content, resources or Community features, no refunds will be provided for:

• Partial months or years
• Unused portions of your membership
• Changed circumstances or dissatisfaction with Services

8.3 Cancellation by Us

We reserve the right to suspend or terminate your membership immediately if you breach these Terms, with no refund of fees paid.

8.4 Access After Cancellation

Upon cancellation:

• Paid tier access ends at the close of your current billing period
• You revert to free tier access
• Downloaded resources remain yours to use
• Community posts you created remain visible unless you delete them

9. Intellectual Property Rights

9.1 Our Content

All Content provided by The AI Foundry, including but not limited to:

• Courses, guides, toolkits, checklists and playbooks
• Podcast episodes and transcripts
• Website design, text and graphics
• Brand assets and logos

is owned by The AI Foundry Limited or our licensors and is protected by copyright, trademark and other intellectual property laws.

9.2 Guest Content

Content created by guest contributors (including podcast guests) is considered joint ownership and is shared according to separate agreements with those contributors.

9.3 Limited Licence to You

We grant you a limited, non-exclusive, non-transferable licence to:

• Access and view our Content for your personal business use
• Download resources provided as part of your membership
• Share our Content via provided sharing tools (e.g. social media share buttons)

You may not:

• Reproduce, modify, distribute or sell our Content without permission
• Remove copyright notices or branding
• Use our Content for commercial purposes beyond your own business
• Share your login credentials or membership access with others

9.4 User Content Ownership

You retain ownership of any User Content you post in our Community. By posting, you grant us and other Community members a non-exclusive licence to view, access and engage with your User Content within the Community.

9.5 Trademark

“The AI Foundry” and our logo are trademarks of The AI Foundry Limited. You may not use our trademarks without our prior written permission.

10. Community Guidelines & Acceptable Use

10.1 Community Standards

Our Community is built on respect, support and practical collaboration. When participating, you agree to:

• Be respectful and supportive of other members
• Share knowledge and experiences constructively
• Keep discussions relevant and helpful
• Respect privacy and confidentiality

10.2 Prohibited Conduct

You must not:

• Harass, bully, threaten or abuse other members
• Post spam, advertisements or promotional content without permission
• Share false, misleading or defamatory information
• Violate any person’s intellectual property rights
• Share illegal, obscene or offensive content
• Impersonate others or misrepresent your identity or affiliation

Community founders moderate all Community activity. Members may report inappropriate content or behaviour using the reporting tools provided.

10.4 Enforcement

If you violate these Terms or Community Guidelines:

• First offence: You will receive a warning
• Continued violations: Your account may be suspended or permanently banned
• Serious violations: We may terminate your account immediately without warning or refund

We reserve the right to remove any User Content that violates these Terms.

10.5 Member Responsibility

You can delete your own posts and content at any time through your account settings.

You are solely responsible for your User Content and the consequences of posting it.

11. Educational Content & Disclaimers

11.1 Educational Purpose

All Content, courses, guides and advice provided by The AI Foundry are for educational and informational purposes only.

11.2 Not Professional Advice

Our Services do not constitute:

• Financial advice
• Technical consulting
• Professional services specific to your business

Partners who display our “Approved Partner” badge or participate in our Partner Programme are subject to separate partnership agreements.

Partner terms, standards, commissions and obligations are not covered by these Terms but by individual partnership contracts.

13. Limitation of Liability

To the fullest extent permitted by law, The AI Foundry Limited shall not be liable for:

• Loss of profits, revenue, business or anticipated savings

• Loss of business opportunity or goodwill
• Any indirect, consequential or special losses

arising from your use of our Services, even if we have been advised of the possibility of such losses.

13.2 Total Liability Cap

Our total liability to you for any claims arising from these Terms or your use of our Services shall not exceed the total fees you have paid to us in the 12 months preceding the claim.
